Learning Objectives: At the conclusion of class, the attendees will be able to
1. Differentiate between the Controlled Substance Act and state decriminalization statutes.
2. Explain how guidance issued by a federal agency is different from federal law.
3. Explain how the “illegality defense” may be used in a contractual dispute to result in a contract being deemed void.
4. Identify three inquiries they should make to their financial institution before agreeing to lease/rent to a cannabis industry client.
5. List five clauses that should exist in a lease with a cannabis industry client or a tenant who plans on consuming cannabis or growing cannabis.
6. Explain how the Kanovsky memorandum impacts denying a reasonable accommodation request by a tenant wishing to use medical marijuana in or around rental premises.
