Bowman, Esq., PE, D.F.E (NAFE#1153) – rbowmanesq@aol.com In 1984, the U.S. Supreme Court established a framework to use in evaluating if a federal agency's statutory interpretation in rulemaking was consistent with the Administrative Procedures Act in its decision in the Chevron case. On June 28, 2024, the U.S. Supreme Court overruled the agency deference test established in the Chevron case in what will likely come to be Loper Bright. While the overturning is momentous in its own right, this decision was (maybe) the final shift in the agency’s deference question. Participants will review the old standard, consider the new standard, and be able to apply the new standard to two scenarios.
