Domestic relations matters involving concerns related to the neurodivergence of a parent or child can generate quite an ordeal. Questions related to a parent’s capacity, the needs of a child, and the resultant fit between capacity and needs can increase conflict, subject an already vulnerable child(ren) to harmful stressors, and increase costs for the family as they work towards what is in the child(ren)’s best interest. This presentation will provide a framework for approaching this matter focusing on common issues related to this subject, outline how to do so in a way that is helpful to both the family and the court, and most importantly how it might be used to support the healthy developmental course of the child(ren) to the ordeal. Case examples will be used to illustrate. Learning Objectives: 1. Understand the difference between the forensic evaluation of a parent or child and a clinical evaluation, how they relate, and why the difference matters in family court. 2. Understand the developmental and capacity needs “map” of a child where neurodivergence is on the table. 3. Understand how to best approach such cases in a way that doesn’t sacrifice the child’s developmental interest to a parent’s right to parent their child.
