Evidentiary Opportunities: Applicability of the Hearsay Rules in Child Custody Proceedings
American Bar Association Section of Family Law Standards of Practice for Lawyers Representing Children in Custody Cases
This presentation focuses on returning to the core principles of effective guardian ad litem (GAL) practice, emphasizing the importance of consistency and clarity in the role of a Program Guardian ad Litem (PGAL) throughout all stages of a case. We will explore how a strong foundational understanding of PGAL responsibilities enhances advocacy for the child, fosters trust in the legal process, and improves collaboration with key professionals—family law attorneys, judges, mental health providers, and other stakeholders. By reinforcing best practices and aligning our approach across cases, PGALs can ensure that the child’s best interests remain central, even in complex and evolving family dynamics.
