In May 2023, the U.S. Supreme Court issued a decision in Sackett vs EPA, that significantly narrowed the scope of wetlands and headwater streams protected under the federal Clean Water Act. Recent analysis suggests the decision eliminates federal protection for nearly 90% of Wisconsin’s wetlands. The purpose of the workgroup is to share information and gather insights about the current and potential implications in Wisconsin. The discussion will be informed by short presentations by invited speakers on the extent of current federal protections, how state and local policies help bridge the gap, and wetland permitting trends pre- and post-decision. We will wrap up by identifying ongoing evaluation needs, and actions that may be needed to track related developments at the state and federal levels.
